In his conduct of the office of President of the United States—and in violation of his constitutional oath faithfully to execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in violation of his constitutional duty to take care that the laws be faithfully executed—Donald John Trump has abused the powers of the Presidency, in that:
Using the powers of his high office, President Trump has unconstitutionally seized the legislative power to declare war as vested in Congress by Article I, Section 8. Specifically, on January 3, 2026, the President directed the Armed Forces of the United States to initiate a kinetic regime-change operation in Caracas, Venezuela, resulting in the extra-judicial extraction of a foreign head of state and the subsequent declaration of a United States military administration over foreign sovereign territory for the purpose of resource seizure. These actions were undertaken without a Declaration of War or an Authorization for Use of Military Force (AUMF). Furthermore, the President has willfully defied the reporting and withdrawal requirements of the War Powers Resolution of 1973 regarding sustained hostilities initiated in September 2025.
In all of this, Donald John Trump has acted in a manner grossly incompatible with self-governance and the rule of law. He has utilized the military as a personal instrument of global asset seizure, threatening the national security of the United States and the stability of the international order.
