RESOLUTION

Impeaching Donald John Trump, President of the United States, for high crimes and misdemeanors.

Resolved, That Donald John Trump, President of the United States, is impeached for high crimes and misdemeanors and that the following articles of impeachment be exhibited to the United States Senate:

Articles of impeachment exhibited by the House of Representatives of the United States of America in the name of itself and of the people of the United States of America, against Donald John Trump, President of the United States of America, in maintenance and support of its impeachment against him for high crimes and misdemeanors.

Article I: Usurpation of the War Power and Unilateral Foreign Aggression

In his conduct of the office of President of the United States—and in violation of his constitutional oath faithfully to execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in violation of his constitutional duty to take care that the laws be faithfully executed—Donald John Trump has abused the powers of the Presidency, in that:

Using the powers of his high office, President Trump has unconstitutionally seized the legislative power to declare war as vested in Congress by Article I, Section 8. Specifically, on January 3, 2026, the President directed the Armed Forces of the United States to initiate a kinetic regime-change operation in Caracas, Venezuela, resulting in the extra-judicial extraction of a foreign head of state and the subsequent declaration of a United States military administration over foreign sovereign territory for the purpose of resource seizure. These actions were undertaken without a Declaration of War or an Authorization for Use of Military Force (AUMF). Furthermore, the President has willfully defied the reporting and withdrawal requirements of the War Powers Resolution of 1973 regarding sustained hostilities initiated in September 2025.

In all of this, Donald John Trump has acted in a manner grossly incompatible with self-governance and the rule of law. He has utilized the military as a personal instrument of global asset seizure, threatening the national security of the United States and the stability of the international order.

Article II: Corruption of the "Take Care" Clause and Obstruction of Statutory Mandates

In his conduct of the office of President of the United States, Donald John Trump, in violation of his constitutional oath and the "Take Care" Clause of Article II, Section 3, has willfully obstructed the execution of federal statutes to protect personal and political associates, in that:

Despite signing the Epstein Files Transparency Act (Public Law 119-38) on November 19, 2025, the President directed the Department of Justice to withhold mandated records beyond the statutory deadlines of December 19, 2025, and January 3, 2026. As of January 5, 2026, the Executive Branch has admitted to withholding over 99% of the required data, including the "Politically Exposed Persons" (PEP) list. By claiming a "Dispensing Power" to suspend the operation of a validly enacted law, the President has attempted to place the Executive Branch above the legislative authority of the United States.

Article III: Criminal Contempt of the Judiciary and the Erosion of Due Process

In his conduct of the office of President of the United States, Donald John Trump has systematically undermined the independence of the Judiciary and utilized wartime authorities to nullify the constitutional rights of the American people, in that:

The President has invoked the Alien Enemies Act of 1798 during a period of peace to justify the summary incarceration and deportation of individuals without judicial review or the due process guaranteed by the 5th and 14th Amendments. When federal courts issued stays against these actions, the President directed Executive Branch agents to willfully ignore such orders. On March 18, 2025, and repeatedly through January 2026, the President has used his office to denigrate and threaten federal judges, inciting public hostility against the Judicial Branch in an effort to subvert the independence of the courts as guaranteed by Article III.

Article IV: Incitement of Domestic Violence and Threats to the Legislative Branch

In his conduct of the office of President of the United States, Donald John Trump has utilized his position to promote extra-judicial violence against the coordinate branches of government, in that:

On November 20, 2025, the President publicly labeled sitting members of the House and Senate "traitors" and declared their legislative actions "punishable by death," thereby inciting his supporters to commit acts of violence against Members of Congress. Further, on January 6, 2026, the President utilized his pardon power to systematically absolve individuals convicted of violent offenses against the United States Capitol, signaling that political violence committed in his name is immune from prosecution.

Closing Declaration

Wherefore, Donald John Trump, by such conduct, has demonstrated that he will remain a threat to national security and the Constitution if allowed to remain in office, and has acted in a manner grossly incompatible with self-governance and the rule of law. Donald John Trump thus warrants impeachment and trial, removal from office, and disqualification to hold and enjoy any office of honor, trust, or profit under the United States.
